Hour I: Background regarding duties, powers and rights under the Federal and PA Constitution. This is to get them firmly grounded in from where the power to search derives and the limits placed upon that power by the federal and state constitutions as well as by statute.
Hour II: The Electronic Communications Privacy Act (“ECPA”). This is the law (there are federal and state versions) that governs how to obtain information from Internet Service Providers.
Hour III: Searching computers. We will cover what constitutes probable cause to search a computer, for what a person can search, when and where the search should be conducted and other current issues.
LUNCH
Hour IV: Writing ECPA Applications and Search Warrants. We will cover what must go into these documents and best practices in writing the affidavits and other documents which are a part of them.
Hour V: Searching Computers in Civil Matters. We will review the technical steps in electronic discovery production in a civil case: 1) preservation; 2) collection; 3) culling; 4) processing into searchable database form for review in native format; 5) lawyer review; 6) electronic printing and production to the requesting party. This will be a broad overview, needed so that the rules we will discuss thereafter make sense. It should not take long because the students’ background should allow me to cover many of these topics in but a few sentences. We will then begin a review of the Federal Rules of Civil Procedure as they pertain to e-discovery production.
Hour VI: Searching Computers in Civil Matters (Part II). We will finish our review of the Federal Rules.
