Downturns in the economy and reductions in force seem to go hand in hand. Unfortunately, employers that implement reductions in force have an increased risk of litigation from unhappy former employees. So, how do you implement a reduction in force, retain your best performers and avoid lawsuits? This presentation will cover the legal issues that should be considered before implementing a reduction in force. It will cover the importance of establishing a selection process based on objective criteria to limit the risk of discrimination claims; the impact on employees on disability and other leaves of absence; severance benefits; and necessary steps to ensure that you are obtaining effective releases. Attendees will leave this presentation with a better understanding of the pitfalls awaiting employers who implement reductions in force, the statutory avenues available to employees seeking to challenge layoff decisions, and how to avoid those legal challenges.
